Vaultiyo Limited ("Vaultiyo", "we", "us") is the operator of the website vaultiyo.com and all associated platform services. Vaultiyo complies with the requirements of 18 U.S.C. 2257 and 28 C.F.R. Part 75 with respect to all visual depictions of actual or simulated sexually explicit conduct published on the platform.
All persons appearing in any visual depiction of sexually explicit conduct on vaultiyo.com were 18 years of age or older at the time such depictions were created. Vaultiyo requires mandatory age and identity verification for all content creators before they are permitted to publish any content.
For the purposes of 18 U.S.C. 2257, Vaultiyo operates as both a primary producer and secondary producer depending on the circumstances of the content creation:
With respect to content uploaded by creators to the Vaultiyo platform, Vaultiyo acts as a secondary producer as defined in 28 C.F.R. 75.1(c)(2). In this capacity, Vaultiyo requires each creator to certify compliance with 18 U.S.C. 2257 record keeping requirements for content they upload depicting real persons. Vaultiyo maintains the required records for each creator including their identity verification documents and the certification of compliance received during account setup.
For any visual depictions of sexually explicit conduct created directly by or at the direction of Vaultiyo, Vaultiyo acts as primary producer and maintains the original records as required under 18 U.S.C. 2257 and 28 C.F.R. Part 75 including copies of each performer's government issued photo identification and date of birth documentation.
Vaultiyo maintains complete records in compliance with 18 U.S.C. 2257 and 28 C.F.R. Part 75. The records maintained include:
These records are retained for a minimum of seven years from the date of production or from the date the depiction is last offered for sale or distribution, whichever is later.
Vaultiyo's designated custodian of records for the purposes of 18 U.S.C. 2257 can be contacted at the following address. Records are available for inspection at this address during business hours as required by law.
To arrange a lawful inspection of records in accordance with 28 C.F.R. Part 75, please contact the custodian of records at the address above with at least 72 hours notice. All inspection requests must be submitted in writing and identify the legal authority under which the inspection is being sought.
All creators on the Vaultiyo platform are required to complete mandatory age and identity verification before their account is approved to publish content. This verification process requires:
No creator account is approved for content publishing until this verification is complete and approved by our Trust and Safety team. Creators who fail verification or who provide fraudulent identification are permanently banned from the platform.
Creators are also required, as a condition of using the platform, to certify that all persons appearing in any content they upload were at least 18 years of age at the time the content was produced, and that the creator holds the appropriate 2257 records for any third parties depicted.
Vaultiyo acknowledges that not all content on the platform constitutes visual depictions of actual or simulated sexually explicit conduct within the meaning of 18 U.S.C. 2257. This compliance statement applies only to content that depicts actual or simulated sexually explicit conduct as defined in 18 U.S.C. 2256(2). Content that does not fall within this definition is not subject to the record keeping requirements of 18 U.S.C. 2257.
The majority of content published on Vaultiyo falls into categories including fitness, travel, photography, fashion, lifestyle, wellness, art, music, and cooking, which do not constitute sexually explicit conduct within the statutory definition. Nevertheless, Vaultiyo applies its age verification requirements universally to all creators regardless of content category.
